    Welcome to the Kembang Kasih Platform. Users are expected to read all provisions in these Terms and Conditions carefully before using the Kembang Kasih Platform, as it affects your rights and obligations as a User of this Kembang Kasih Platform. If a User engages in activities such as visiting, registering, and/or using this Kembang Kasih Platform, the User declares that they have read, understood, comprehended, and agreed to all provisions, including any changes and/or additions to the provisions from time to time which are an integral part of these Terms and Conditions. By accessing or using the service, you agree to every Policy, Term and Condition on the Kembang Kasih Platform. If the User does not agree to one, part, or all of the provisions in these Terms and Conditions and their changes, then the User is not permitted to use the services on this Platform.

    Important

    The Privacy Policy referred to on this page is a reference to regulate as well as a form of real commitment from the Kembang Kasih Platform to protect the use of Personal Data and Metadata belonging to the User. Every term and definition described in the Terms and Conditions also applies to this Privacy Policy. Kembang Kasih has the right to modify, add, and/or change the Policy at any time by providing notification to the User through Kembang Kasih's communication media. The new rules will take effect after the notification has been published or sent to all Users of the Kembang Kasih Platform. The agreement may not apply if there are changes due to Indonesian law and the Kembang Kasih Platform policy will change in accordance with applicable laws and regulations.

    A. Agreement

    If the User accesses, registers, and/or uses the services on the Kembang Kasih Platform, then the User declares that any data provided is true and valid data. You as a User acknowledge that you have obtained and understood the provisions of this Privacy Policy and give consent to Kembang Kasih to collect, store, obtain, use, process, control, transfer, send, disclose, and protect your data to facilitate various service processes within the Kembang Kasih Platform and other purposes as long as permitted by applicable laws and regulations.

    B. Data Acquisition and Collection
    1. Kembang Kasih collects and uses User Data so that the Kembang Kasih Platform can be used according to its purpose, to support performance efficiency, and to improve the quality of Kembang Kasih Platform services.
    2. The data that the Kembang Kasih Platform collects includes Personal Data, Metadata, and other information that the User provides directly or that is collected automatically due to the use of the Kembang Kasih Platform. Data submitted by the User independently, including but not limited to being submitted in the process:
      • Creation and/or updating of a Kembang Kasih account, including full name (username), email address, mobile number, password and other information that can identify the User;
      • Filling out surveys sent by Kembang Kasih;
      • Filling in the data required when making a Donation, such as full name, email address, mobile number, and/or other additional information requested if the Donor uses a payment method with bank transfer services, virtual accounts (“VA”), debit/credit cards, and electronic wallets registered with Bank Indonesia and in cooperation with Kembang Kasih;
      • Filling in the data required when creating a Fundraiser (Donation), such as full name, email address, mobile number, social media address, and/or other information as needed by the Kembang Kasih Platform;
      • Verification and/or disbursement, such as identity documents, medical documents, National Identity Card (“KTP”), Family Card (“KK”), proof of payment documents or other information in other forms and ways that the Kembang Kasih Platform may request from time to time;
      • Collection of documents required for special cooperation, including but not limited to written agreements made separately from this Privacy Policy; and/or
      • Data that is collected automatically when the User uses the Kembang Kasih Platform such as internet protocol address, geolocation, operating system and browser version of the device you use to access the Kembang Kasih Platform, data traffic, site recordings, and other communication data.
      • Use of other data used for Kembang Kasih's internal purposes.
    3. Kembang Kasih may collect Cookies contained in the User's device browser as long as the Kembang Kasih Platform is used to recognize and remember certain information, including session management, service personalization, and recording of User activity on the Kembang Kasih Platform. The User can disable Cookies on the site, but this may limit the optimization of services when you access the site.
    C. Use of Data
    1. Kembang Kasih may use the Data for the following purposes, as well as for other purposes permitted by applicable laws and regulations, including:
      • Identifying and processing applications for the use of the Kembang Kasih Platform, including facilitating or carrying out any verification that Kembang Kasih deems necessary for the purpose of using the Kembang Kasih Platform and/or implementing the know your customer (Know Your Customer) principle;
      • Providing Kembang Kasih Platform services.
      • Providing notifications or information related to the use of the account, the Kembang Kasih Platform, and/or Kembang Kasih Platform services, including any updates or changes to the Kembang Kasih Platform or Kembang Kasih Platform services;
      • Enabling Users to use interaction/communication features with Kembang Kasih through the Kembang Kasih Platform, including consumer services to answer questions and/or complaints;
      • Striving to ensure that the content, content, and all information on the Kembang Kasih Platform are displayed in the most effective way for the User and the electronic device the User uses;
      • Monitoring and/or analyzing the use and management of the Kembang Kasih Platform to support the efficiency and effectiveness of the Kembang Kasih Platform and its functions, including patterns of use of the Kembang Kasih Platform as well as activities, behavior and demographic data, including habits and use of various services available on the Kembang Kasih Platform;
      • Improving, enhancing the quality of, and/or developing services on the Kembang Kasih Platform;
      • Providing assistance in connection with efforts to resolve operational and technical problems on the Kembang Kasih Platform;
      • Preventing, detecting, and/or investigating any prohibited, illegal, unlawful activities or any form of fraud;
      • Generating information and analysis data for the purpose of testing, research, analysis, product development, commercial partnerships, and cooperation;
      • Enabling Kembang Kasih to comply with all obligations under applicable laws and regulations; and
      • Contacting the User through the communication media provided by the User to Kembang Kasih in connection with the use of Kembang Kasih Platform services.
    2. The use and storage of Data will be carried out by Kembang Kasih according to applicable legal provisions.
    3. Data, including User's Personal Data, will only be stored as long as necessary to fulfill the purpose of its collection, or as long as such storage is required or permitted by applicable laws and regulations. Kembang Kasih will stop storing Personal Data as soon as it is deemed that the purpose of collecting and storing such Personal Data is no longer required for the purpose of Kembang Kasih Platform services or by law.
    4. The User acknowledges and agrees that there is a possibility that data, including the User's Personal Data, is reasonably obtained and stored by Kembang Kasih, and hereby agrees to release Kembang Kasih (and any officials, directors, commissioners, employees, agents, affiliates, partners, suppliers, and contractors) from and against any and all claims, losses, liabilities, costs, damages, and expenses (including but not limited to legal fees and full indemnity expenses) arising as a result of Circumstances and/or technological failures in the form of unauthorized or unlawful use, storage and/or disclosure of data, including the User's Personal Data.
    D. Provision or Disclosure of Data
    1. The User agrees to the provision or disclosure of data, including the User's Personal Data, by Kembang Kasih to third parties that are reasonably necessary to improve the performance and quality of the Kembang Kasih Platform, develop the features of the Kembang Kasih Platform, services, and products that Kembang Kasih offers, among others, to carry out maintenance and management of Kembang Kasih's systems, devices, and networks, to consultants, auditors, service providers, and/or professional advisors.
    2. Kembang Kasih may provide or disclose data, including User's Personal Data, if required by a court order or decision, order, or decision from an authorized institution, to comply with applicable laws and regulations, or in the event of legal proceedings, taking further preventive measures in connection with unauthorized or unauthorized activities, or suspected criminal acts or legal violations.
    3. Kembang Kasih will make reasonable efforts to delete irrelevant Personal Data before providing or disclosing data, including the User's Personal Data.
    4. Kembang Kasih may remove certain parts of the User's Personal Data that can identify the User, so that it becomes anonymous data, and disclose such anonymous data to third parties. Kembang Kasih may also combine the User's Personal Data with other information in such a way that the information is no longer associated with the User, then disclose the combined information to third parties.
    5. Kembang Kasih does not sell, distribute, or rent User's Personal Data to any third party.
    6. If the User consciously checks the “I agree to be contacted…” checkbox when making a Donation in a particular Fundraiser (Donation), then the User agrees and authorizes Kembang Kasih to provide or disclose data, including the User's Personal Data, namely the name and email address registered on the Kembang Kasih Platform, to third parties approved by the User and cooperating with Kembang Kasih for the operation of the Kembang Kasih Platform.
    E. Security

    The confidentiality of User's Personal Data is very important to Kembang Kasih. The Kembang Kasih Platform strives and takes reasonably necessary steps to protect the security of data, including the User's Personal Data, among others, through the use of technology to scramble communication paths between computers so that they cannot be read by other parties. However, Kembang Kasih cannot fully guarantee that the Kembang Kasih system is completely impenetrable by viruses, malware, disruptions, hacking, legal violations or unauthorized access by third parties.

    F. Right of Access and Request for Changes to Personal Data

    The User has the right to access the User's Personal Data stored on the Kembang Kasih Platform by submitting an access request through Kembang Kasih.org. The User also has the right to change the stored Personal Data, such as email address, mobile number, password by submitting such notification and other information required by the Kembang Kasih Platform through [write Kembang Kasih site].

    G. Request for Deactivation and/or Deletion of Account and Personal Data
    1. The User has the right to request the deactivation and/or deletion of the User's account and Personal Data stored on the Kembang Kasih Platform by agreeing to and complying with the requirements and procedures determined by applicable laws and regulations, by submitting a request and providing the information required by the Kembang Kasih Platform through [write Kembang Kasih site] and/or the deactivation and/or deletion account feature, with the condition:
      • Send an email using the email address registered with Kembang Kasih;
      • Photo of the latest identity card;
      • Photo of self holding an identity card.
    2. The User understands and agrees that the deactivation and/or deletion of the User's Account and Personal Data, either in part or in whole, may result in the User no longer being able to use the Kembang Kasih Platform.
    3. Kembang Kasih will evaluate the request for deactivation and/or deletion of the account and User's Personal Data. If it does not meet the terms and conditions for deactivation and/or deletion of the account and Personal Data, Kembang Kasih will confirm with the User, where the User agrees to be contacted. The terms and conditions related to the deactivation and/or deletion of accounts and Personal Data can be seen on the How to Deactivate an Account and Personal Data at Kembang Kasih page.
    H. Changes

    At Kembang Kasih's own discretion, Kembang Kasih has the right to change the Privacy Policy at any time by providing notification to the User. The User can access any changes to this Privacy Policy on the Kembang Kasih Platform. When accessing and/or using the Kembang Kasih Platform, the User acknowledges having obtained, understood, and given consent to the changes in the provisions of the Privacy Policy. If the User does not agree to one, part, or all of the changes to the Privacy Policy, then the User is not permitted to use the services on this Kembang Kasih Platform.

    I. Governing Law and Disputes

    This Privacy Policy and its implementation are governed by and subject to Indonesian law.
    The User and Kembang Kasih agree to resolve any disputes in connection with this Privacy Policy by deliberation and consensus. If the dispute cannot be resolved by deliberation and consensus within 30 (thirty) calendar days from the receipt of written notification by one Party given by the other Party about the occurrence of the dispute, then the said dispute will be resolved through the Indonesian National Arbitration Board (“BANI”).

    J. Contact

    The User may submit suggestions, requests, complaints or questions related to the Kembang Kasih Platform to Kembang Kasih through [write Kembang Kasih site]. Kembang Kasih will verify the User's information or data before responding to or responding to the User's suggestions, requests, complaints, and/or questions. Kembang Kasih has the right to refuse to process or respond to the User's suggestions, requests, complaints, and/or questions when the information or data provided by the User does not match the information or data listed on the Kembang Kasih Platform system.
    The process of verification to providing a response or response to suggestions, requests, complaints, and/or questions from the User is carried out in accordance with the Privacy Policy and Kembang Kasih's internal policies and procedures that apply from time to time.
